Utah Adoption Lawsuit in the National Spotlight

Fox News Channel’s Megyn Kelly, host of the Kelly File, highlighted a February 2013 report by Alicia Acuna which discussed a lawsuit brought against the state of Utah by a dozen unmarried fathers whose children were 12553620_sadopted in Utah without their knowledge. This lawsuit has also been featured in previous installments of this blog.

FoxNews.com reports that twelve single fathers are suing the state of Utah in federal court because Utah law allows mothers to put their babies up for adoption without the biological father’s knowledge or consent. The civil suit alleges that the Utah Adoption Act has results in what amounts to “legalized fraud and kidnapping.”

Acuna’s report includes the story of Nicholas Thurnwald, one of the fathers suing the state of Utah, whose child was born in 2004 and put up for adoption in Utah without his consent:

“Well, I thought I was going to have a son, “We were together all the way up until the last couple of days before the birth…[I called my pregnant at work one day] “to see if she maybe wanted to go to the movies, and her co-worker answered the phone at the department store that she was working at and basically let me know that she was in the hospital having our baby…[I called the hospital immediately and]…[t]hey patched me through to her … and I asked her if she was giving our son up for adoption. And she said, ‘Kinda.’ I said ‘there is no kinda, what are you doing? Why are you doing this?’ And she says, ‘Look I gotta go.’ I dropped to my knees, dropped my phone that I was holding and just started crying. A grown man on a construction site crying his eyes out (sic).”

When Thurnwald drove to the hospital, he was told that his girlfriend was not a patient there, although he explained that he had just spoken to her on the phone and she told him that she was.  According to Thurnwald, “They said, ‘Sir, you need to leave before we call the police’.”

After nearly 10 years and more than $30,000 in legal fees, Thurnwald ultimately lost his bid to gain custody. But, as of this writing, he still has not given up.
